1. Agreement to Terms
By accessing or using My Favorite Bra Inc. (“we”, “us”, “our”, the “Company”) website located at www.myfavoritebra.com (the “Site”) and purchasing products from us, you (“you”, “your”, “Customer”) agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, Return Policy, and any other policies posted on the Site. If you do not agree with any part of the Terms, you must not use the Site or make a purchase.

2. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we do, we will post the updated Terms on the Site and update the “Last updated” date above. Your continued use of the Site or purchase of products after such changes constitutes your acceptance of the updated Terms.

5. Products, Orders & Pricing
a) All purchases made through the Site are governed by these Terms and any order confirmation you receive.
b) We may, at our sole discretion, limit or cancel quantities purchased, refuse orders, or discontinue products, whether or not the order has been accepted.
c) We attempt to display as accurately as possible the colors and images of our products, but we cannot guarantee that your device’s display will reflect the actual color.
d) Prices and availability of products are subject to change without notice.
e) Payment must be authorized at the time of purchase. You agree to provide current, complete, and accurate payment information and to promptly update such information if it changes.

6. Shipping, Returns & Refunds

7. Disclaimers & Limitation of Liability

c) Our total liability to you for all claims under these Terms, whether in contract, tort, or otherwise, will not exceed the amount you paid to purchase the product(s) giving rise to such claim.

8. Indemnification
You agree to defend, indemnify, and hold harmless My Favorite Bra Inc. and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, losses, liabilities, damages, judgments, or expenses (including attorneys’ fees) arising out of your use or misuse of the Site or products, your breach of these Terms, or your violation of any law or third-party rights.

9. Governing Law & Dispute Resolution
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

10. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease. Sections 3, 4, 5 (as applicable), 6 (as applicable), 7, 8, 9, and this Section 10 will survive termination.

11. Miscellaneous
a) If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of the Terms will remain in full force and effect.
b) The failure of the Company to enforce any right or provision under these Terms will not constitute a waiver of such right.
c) These Terms constitute the entire agreement between you and the Company regarding the use of the Site and supersede all prior agreements or understandings, whether written or oral.
